Pursuant to Article 11(1) of the Regulation (EU) 2016/589 of the European Parliament and of the Council of 13 April 2016 on a European network of employment services (EURES), workers’ access to mobility services and the further integration of labour markets, and amending Regulations (EU) No 492/2011 and (EU) No 1296/2013, and pursuant to the Decision establishing a System for the Admission of Members and Partners to the National EURES Network (Class: 023-01/18-01/01, Reg. No: 344-70/1-18-83) of 10 May 2018, and the Decision amending the Criteria under the System for the Admission of Members and Partners to the National EURES Network (Class: 100-01/18-01/150, Reg. No: 344-48/1-21-10), the Croatian Employment Service, acting as a National Coordination Office for EURES, hereby publishes the following:
PUBLIC INVITATION
to admit Members and Partners to the national EURES network
I
EURES (EURopean Employment Services) is a cooperation network that consists of Member States of the European Economic Area and Switzerland, and its work is coordinated by the European Coordination Office for EURES. It was established in 1993 and launched in 1994 as a tool to improve mobility, i.e. the spatial and professional mobility of the workforce on the European labour market. The free movement of workers is a fundamental freedom of Union citizens and one of the pillars of the internal market, enshrined in Article 45 of the Treaty on the Functioning of the European Union (TFEU).

The subject of the public invitation is to expand the national EURES network in order to increase efficiency, complementarity and quality in the provision of recruitment and placement services, as well as other related services, to mobile workers and employers.

The public invitation is open to natural and legal persons, institutions and non-profit organisations lawfully engaged in an activity in the Republic of Croatia and meeting the prescribed conditions.

Applicant organisations can become part of the EURES network as Members or Partners.
V
In order to be appointed as EURES Members, employment service providers are required to be duly registered in the register of the ministry responsible for labour and to have been lawfully engaged in this activity in the territory of the Republic of Croatia for at least two years at the time of submitting the application, in accordance with the Ordinance on the Performance of Activities Related to Employment (OG No 28/19). Moreover, they need to have the capacity to fulfil all the tasks required by Article 12(2)(a), (b) and (c) of Regulation (EU) 2016/589 for EURES Members:
- contributing to the pool of job vacancies in accordance with point (a) of Article 17(1)
- contributing to the pool of job applications and CVs in accordance with point (b) of Article 17(1)
- providing support services to workers and employers in accordance with Articles 23 and 24, Article 25(1), Article 26 and, where relevant, Article 27.
They must also undertake to fulfil all the obligations of EURES Members as defined in Regulation (EU) 2016/589.

Legal and natural persons, institutions and non-profit organisations lawfully engaged in a registered activity in the Republic of Croatia for at least two years at the time of submitting the application may be appointed as EURES Partners. Candidates for appointment as EURES Partners who carry out activities related to employment are subject to the criterion of performance of that activity in accordance with the Ordinance on the Performance of Activities Related to Employment (OG No 28/19) and are required to duly substantiate that, on the basis of the size of their organisation, financial resources, nature of the services normally provided by the organisation, or organisational structure, they can fulfil at least one and at most two obligations set out in Article 12(2)(a), (b) and (c) of Regulation (EU) 2016/589:
- contributing to the pool of job vacancies in accordance with point (a) of Article 17(1)
- contributing to the pool of job applications and CVs in accordance with point (b) of Article 17(1)
- providing support services to workers and employers in accordance with Articles 23 and 24, Article 25(1), Article 26 and, where relevant, Article 27.
They must also undertake to fulfil other obligations of EURES Partners as defined in Regulation (EU) 2016/589.
All applicants, regardless of whether they are applying to be appointed as Members or as Partners, must meet the following conditions:
- they have no outstanding obligations in respect of public levies at the time of submitting the application;
- no proceedings have been initiated against the natural or legal person or responsible persons for violating regulations in the area of labour, employment, or exercise of a registered activity, and there are no criminal proceedings pending;
- the organisation or responsible person have not had penalties imposed on them for administrative or criminal offences in the aforementioned areas in the two years prior to submitting the application.
VII
A complete application contains the following:
- copy of proof of registration
- debt balance certificate obtained from the Tax Administration not older than 30 days (available in the form of an electronic record via the Tax Administration’s Single Portal – ePorezna (e-Tax Administration))
- completed form containing the following declarations:
- under substantive and criminal liability of persons authorised for representation, regarding the compliance with the conditions laid down in point III in respect of violation of regulations in the area of labour, employment, or exercise of a registered activity
- for Members: declaration by the person authorised for the representation of the applicant stating that the organisation undertakes to provide all EURES services referred to in Article 12(2)(a), (b) and (c) of Regulation (EU) 2016/589
- for Partners: declaration by the person authorised for the representation of the applicant stating that the organisation undertakes to provide at most two EURES services referred to in Article 12(2)(a), (b) and (c) of Regulation (EU) 2016/589
VIII
The public invitation was published on the websites of the Croatian Employment Service and the Ministry of Labour, Pension System, Family and Social Policy. Application forms are available to download below: Form 1 (application for Member status), Form 2 (application for Partner status). Before submitting an application, applicants are required to read the admission, monitoring and revocation criteria, which can also be found below. By submitting the application, the applicant declares that they are aware of the criteria.
Applications are to be submitted in electronic format (.PDF format) to NKU-EURES@hzz.hr, indicating the following in the subject of the email: Application in response to the Public invitation to admit Members and Partners to the national EURES network.

The time limit for taking a decision is 30 days from the receipt of the complete application. Applicants will be informed of the decision in writing to the email address provided in the application. Complaints against decisions rejecting an application are decided on by an expert committee appointed by the director of the Croatian Employment Service.
